Lapel Planning Commission Meeting

October 8, 2020

Lapel Eagles

Call to order: Gary Shuck, Angie Duncan, Tony Hewitt, Trefin Luker, Teresa Retherford, Kourtney Krabbe, and Chris Hobbs.

President Gary Shuck suspended regular meeting and opened the public hearing for the Roscoe Dorsey property at 6208 SR 13. Dorsey is wanting to rezone the 20 acres from agriculture to general industrial. He is hoping to have 8-10 private commercial lots with a drive straight down the middle connecting SR 13 and 875W. Retherford asked if they are planning to keep the white house that would be beside this complex. Dorsey stated he is hoping to keep it there as long as possible as it does not affect development. However he will need to get State approval for the drive cut off SR 13, and that may affect whether the house stays or gets torn down. Dorsey stated he would like to get his building put in first before the rest of the development starts construction. Shuck asked if there was a master plane for drainage. Dorsey stated not yet, he will get to work on the drawings and preliminary plans if this rezoning gets approved. Dorsey stated his image for the complex is two story buildings for landscapers, excavators, etc. with clean looking outdoor storage. Shuck mentioned that volume10 in the Lapel zoning codes has everything that can and cannot be put in a general industrial area. Carolyn Wilson at 3154 Myrtle Drive stated that she really appreciated receiving notification about this zoning, as it has not been done before in the past. Being no further public comment or question Shuck closes the public hearing, and reopens the regular planning commission meeting.

A motion to send the Dorsey rezone from Ag to Ig to the Lapel Town Council with a favorable recommendation was made by Hewitt, 2nd by Retherford; all were in favor.

Shuck suspends the regular planning commission meeting, and opens a public hearing for the Courtney Duncan rezone at 501 S Walnut. Duncan is wanting to rezone her property from commercial to R2 so she can sell her home. Mr. Ron Stephenson is representing Ms. Duncan tonight. Stephenson states there is a small building in the back of the property that use to be used as a barber shop which is why it is zoned commercial. All the surrounding building, except for the one across the street, are all zoned at R2. Stephenson and his surrounding neighbors have no issue with Ms. Duncan rezoning the property back to R2. Shuck stated that the building in the back is approximately 400 sq. ft., which is too small to be considered a rental property. Being no further public comment or question, Shuck closes the public hearing and reopens the regular planning commission meeting.

A motion to send the Duncan rezone from C1 to R2 to the Lapel Town Council with a favorable recommendation was made by Retherford, 2nd by Luker; all were in favor.

A public hearing for both the Dorsey property, and Duncan property will be held on October 15th at 7pm at the Lapel Eagles.

A motion to approve the September 10th, and September 24th meeting minutes was made by Luker, 2nd by Retherford; all were in favor.

A motion to approve building permits 2495-2534 was made by Retherford, 2nd by Duncan; all were in favor.

Old Business: 9187 Beechwood Drive is wanting to put in a pool that would go over the drainage and gas easement. They do not want to shrink the size of the pool because they would like to put in a diving board, and minimum standards to do so is 16X32. Lapel zoning codes state the pool needs to be 10ft off the property line. Shuck suggests the homeowners move the pool closer to the home that way just the concrete apron would be in the easement; and if the Town needed to go in and make a repair they would just tear up the concrete apron instead of the entire pool. The homeowners would need to apply for a variance in order to have the concrete apron over the easement. Retherford would like for Chris Hobbs to get in touch with Brandon Hutchison, Gas Operator, to locate exactly where the gas lines are out there.

Shuck wanted to info the rest of the board that we are in a small dispute with the Madison County Drainage Board as they have relinquished all jurisdiction for the drainage in the Montgomery Farms housing addition. Retention ponds cannot be dedicated to the Town. Shuck stated that Mr. Fiddler, representative of Montgomery Farms, would like to lower the water level in the ponds by 1ft. The board agrees that the residents of Montgomery Farms need to set up an HOA to help manage the common areas since they are not the responsibility of the Town of Lapel.

Being no further business to discuss, meeting was adjourned.
