Lapel Town Council Special Meeting

April 1, 2021 @ 6:30pm

Lapel Town Hall

Call to order: Attending in person was Chad Blake, Teresa Retherford, Paula Lee, and Kourtney Krabbe. Attending virtually was Lindsay Washmuth, Tom Marvel (arrived at 6:34pm), and Ashley Hopper Town Attorney. Not present was Jason Kleinbub.

The advertisement for paving bids was in the Herald Bulletin on 3/17/21 & 3/24/21, as well as the Town’s Facebook page.

Lee passes the bids off to Blake, and states they will be open in the order they were submitted. The first bid is from DC Construction submitted at 1:57pm on 4/1/2021 totaling at $628,287.68. The second bid is from E&B Paving submitted at 3:38pm on 4/1/2021 totaling at $770,347.10. The third bid is from Midwest Paving submitted at 3:56pm on 4/1/2021 totaling at $689,788.66.

Motion to take bids under consideration & discuss them at the 4/5/2021 meeting was made by Blake, 2nd by Retherford; all were in favor.

LRC report: Ashley Hopper states the Lapel Town Council does not need to approve the LRC report. The LRC approved this report on 3/23/2021 which was prior to the 4/1/2021 deadline, and the Lapel Town Council just needs to acknowledge this report prior to 4/15/2021.

Small Purchase Resolution is being tabled until 4/15/2021.

Conflict of Interest Statement: This was discussed at the last meeting on 3/18/21, which stated Retherford sewed patches on the police uniforms. Motion to approve the conflict of interest statement for Teresa Retherford was made by Blake, 2nd by Washmuth; voting yes was Blake, Marvel & Washmuth, Retherford abstained. Motion passes.

EJP Service Agreement: Lee presented the EJP Service Agreement for Annual Sensus Software and Hardware Support. This agreement comes with three options of service. Option 1 is for the “Standard” Sensus Support Program for $2,500/year. Option 2 is for the “Enhanced” EJP Support Program for $3,600/year which comes with loaner equipment during repair. Option 3 is to sign no contract of service, and pay $350 per handheld fix. Motion to accept option 2 for $3,600/year annual agreement with EJP was made by Retherford, 2nd by Blake; all were in favor.

Constellation New Energy Payment Plan: The town consulted with our legal team, and Reedy Financial on the payment plan agreement provided by Constellation New Energy, and both parties gave a favorable recommendation for the agreement. The agreement states that the $402,590.06 will be split up into 24 monthly installments at $16,744.59, plus interest at 4% per annum. Motion to accept the payment plan agreement with Constellation New Energy was made by Blake, 2nd by Retherford; all were in favor. Ken Delabastide from the Herald Bulletin asked if there is a penalty to pay off the agreement early. Blake states that there would be no penalty to pay it off early.
