Letter to Residents with Basketball Goals on Town Streets

This is what the contents of the letter will contain:

Due to the number of complaints received we are asking everyone with basketball goals set on the right of way of the street to please remove them, as they are causing children to play in the street, which creates a safety problem.  They are also in violation of Indiana Law IC 35-42-2-4 which is a Class A Misdemeanor, which states in part a person who recklssly, knowingly, or intentionally obstructs vehicular or pedestrian traffic commits obstruction of traffic.  It could also be a felony if the violation results in serious injury.

Yes, you are being identified as being in violation and to prevent the goals being removed at the owners expense and or receiving a notice of violation, move the goals onto your own property, which in most cases would mean 10 feet from the edge of the roadway.  On or after September 11, 2012 enforcement will be taken against owners of goals not moved.

Due to the location of some of these goals in relation to home addresses it is possible that some letters may be sent to the wrong individuals. I.e. where a goal is not clearly in front of anyone particular home the nearest home may get the letter.

If you believe you received a letter in error either contact Town Hall or if you know your neighbor owns said basketball goal please deliver the letter to them.

As the letter indicates these goals are obstructions to vehicular or pedestrian traffic and can cause a problem.
