Lapel Planning Commission

March 11, 2021

Lapel Eagles

Call to order: Gary Shuck, Matt Wood, Jeff Keith, Paula Lee, Teresa Retherford, Dan Paddock, Kourtney Krabbe, Neil Stevenson from Madison County Council of Governments, and Shanna Kelly, Town Attorney.

Shuck suspended the regular scheduled meeting, and opened a public hearing for the Lapel Comprehensive Plan. This public hearing was advertised in the Herald Bulletin on 2/27/21, and on Lapel’s Facebook page 2/23/21. Ken Remenschneider from Kimley-Horn Associates presented the comprehensive plan to the planning commission. Jennifer McCrory of Fishersburg expressed her opposition to Fishersburg being annexed into the Town of Lapel. Shuck assured her that the comprehensive plan is only a guide, and not set in stone events. With no further public comment, Shuck reopened the regular scheduled meeting.

Lee stated the Lapel Steering Committee had a lot of public engagement throughout the meetings over the last couple of months. A motion to give the comprehensive plan a favorable recommendation to the Lapel Town Council was made by Lee, 2nd by Retherford; all were in favor.

Arbor Homes/Hallmark Homes: Steve Servies wanted to follow up from last meeting on 2/25/21. The Planning Commission would like to see two entrances to the addition opposed to the one proposed entrance. The plans also show the sidewalks being 4ft wide, yet the R2 zoning codes state sidewalks must be a minimum of 5ft wide. Linda Clark, 634 Central Ave, expressed her concerns regarding a drainage tile on her property. Neil Stevenson stated that the planning commission needs to follow the guidelines in zoning ordinance volume 12 in regards to the next steps of this project. He stated this meeting would be considered a preliminary meeting. Pam Shuck, 227 E 9th Street, asked if anyone has reached out to the school facilities to make sure they can accommodate more students.

A motion to approve building permits 2564, 2565, & 2570 was made by Retherford, 2nd by Keith; all were in favor.

A motion to approve February 11th meeting minutes was made by Paddock, 2nd by Wood; all were in favor.

A motion to approve February 25th meeting minutes was made by Keith, 2nd by Lee; all were in favor except Retherford who was not present for said meeting.

Permit Fees: It was acknowledged that Lapel’s building permit fees can be confusing, and we should look at other towns to see how we can adjust ours. Neil Stevenson can help with the fee table. Further discussion will be held at the meeting in April.

Montgomery Farms Phase 4: Richard Fiddler spoke to the Madison County Drainage Board and states they say the original master plan shows drainage ponds, so phase 4 must have those ponds and not dry retention. Mr. Fiddler was referring to the old zoning ordinances when he found the specs for the drainage ponds. Lapel Planning Commission stated he needs to refer to the new zoning ordinances Vol. 1-12 which were updated in 2015. The Planning Commission also asked if the staff at Town Hall can get with Daniel Paull to find a solution so that newer ordinances show up before older ones on the town’s website.

The next Lapel Planning Commission Meeting will be moved from 4/8/21 to 4/14/21 due to a lack of attendance caused by spring break. The time & place will remain the same; 6:30pm at the Lapel Eagles.

Being nothing further to discuss, the meeting was adjourned.
