LAPEL TOWN COUNCIL SPECIAL MEETING

NOVEMBER 10, 2021

In attendance in person: Chad Blake, Teresa Retherford, and Paula Lee.  In person virtually Tom Marvel, Lindsay Washmuth, Attorney for the Town Jeff Graham and Gary Smith of Reedy Financial.  Jason Klienbub was absent.

7pm, meeting called to order, this meeting was held at the Lapel Town Hall with access via GoToMeeting link on our website and Facebook page.

Motion to suspend Special Meeting and open a Public Hearing for Ordinance 17-2021 AN ORDINANCE AMENDING ORDINANCE 9-2011, ESTABLISHING NEW RATES AND CHARGES FOR THE USE AND SERVICES RENDERED BY THE WATER WORKS SYSTEM OF THE TOWN OF LAPEL, INDINA made by Retherford, 2nd by Blake and all were in favor. 

Gary Smith of Reedy Financial addressed the Council on the rate ordinance, a previous water rate increase of 43% has been reduced to 27% by the refunding/refinancing of the 2000 and 2011 water bonds.

Blake asked for public comment both in person and online.  Todd Troup (virtual participant) new owner of the Lapel Laundry expressed concern over the rate increase as a new business owner in Town. Blake explained the rates are tiered representing a lower rate for a higher volume of water used and would be posted online to our Facebook page.  No further questions were raised by the public online or virtually.

Motion made by Retherford to close the Public Hearing for Ordinance 17-2021 and reopen the Special Meeting, 2nd by Marvel and all were in favor.

Motion made by Retherford to adopt Ordinance 17-2021, 2nd by Washmuth and all were in favor.

Motion made by Blake to adopt Ordinance 18-2021 AN ORDINANCE AUTHORIZING THE CURRENT REFUNDING OF THE TOWN OF LAPEL, INDIANA, WATERWORKS REVENUE BONDS, SERIES 2000, AND THE TOWN OF LAPEL, INDIANA WATERWORKS REVENUE BONDS, SERIES 2011, THE ISSUANCE AND SALE OF REFUNDING REVENUE BONDS TO PROVIDE FUNDS FOR THE PAYMENT OF THE COSTS THEREOF, AND THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SUCH WATERWORKS AND OTHER RELATED MATTERS, 2ND by Retherford and all were in favor.

Motion made by Marvel to waive the 2nd and 3rd reading of Ordinance 18-2021, 2nd by Retherford and all were in favor.

Drew Wolfred of Kimley Horn presented DC Construction’s Change Order #5 in regards to 500 S

Prior to completing the full depth reclamation or any subgrade remediation on 500 S, Contractor shall mill an average depth of 2: across the project limits shown on plan sheets R6.0 and R6.1.  This area is estimated to be no greater than 5,200 square yards.  The actual area to be milled will be marked and filed measured by the Engineer/Inspector prior to the milling.

After the 2”milling is complete, Contractor will proofroll the existing gravel base per INDOT Specifications.  If all areas pass the proofrolling test, Contractor may proceed with placing the asphalt base course.  If there are areas that do not pass the proofrolling test, the Contractor shall document and identify these areas along the road.  Contractor shall consult with the Inspector and Engineer prior to proceeding with any remediation measures.  If directed by the project team, Contractor may remediate areas of poor subgrade by increasing the milling depth and replacing the existing material with compacted #53 aggregate.

For pricing of this change order, it’s assumed that the Contractor will mill a maximum of 4” across the total area (5.200SY) of the project.  The cost to complete the 4” milling will be paid for at $3.84 per square yard which would result in an estimated total cost of $19,968.00.  If contractor only needs to mill the top 2” of pavement material to pass the proofroll test, the cost to complete the work is paid for at $1.92 per square yard at an estimated cost of $9,984.00.

Motion made by Retherford to approve Change Order #5, 2nd by Blake and all were in favor.
