Lapel Planning Commission

April 14, 2021 @ 6:30pm

Lapel Eagles

Call to order: Teresa Retherford, Paula Lee, Matt Wood, Angie Duncan, Jeff Keith, Kourtney Krabbe, and Jeff Graham Town Attorney.

Paul Sheller approached the Planning Commission with hopes to build a home at 104 S Ford Street. There are currently three open lots next to each other, and his hopes are to build on lot 17 then combine the other two lots and build a home on that new combined lot. Sheller wants to make sure he can build on that lot, and his plans would be approved before he spends the extra money to have a professional draw up building plans. Due to lot 17 being small, Sheller will need to apply for a variance with the BZA to waive the current setbacks of the front, and sides of the property. If the variance is approved he will then need to apply for a building permit.

A motion to approve building permits 2566-2569 and 2571-2579 was made by Duncan, 2nd by Wood; all were in favor.

A motion to suspend the regular meeting, and open a public hearing for the Lapel Comprehensive Plan was made by Duncan, 2nd by Wood; all were in favor. This public hearing was advertised in the Herald Bulletin on April 1, 2021 as well as on the Lapel Facebook page. Wood asked if there was any comments from the public, or the planning commission; no comments were made.

A motion to close the public hearing and reopen the regular meeting was made by Retherford, 2nd by Lee; all were in favor.

A motion to send the Lapel Comprehensive Plan to the Lapel Town Council with a favorable recommendation was made by Duncan, 2nd by Retherford; all were in favor.

A motion to approve March 11 meeting minutes was made by Lee, 2nd by Retherford; all were in favor except Duncan who abstained due to being absent at last meeting.

New Business: Steve Servies representing Lapel Common’s housing addition stated the plat currently has 84% of the common area required, and is missing the other 16% due to adding the seconded entrance that the Planning Commission requested. Discussion was held about potentially approving the primary plat pending the review of Neil Stephenson at MCCOG, and with review of the public notice. After approval of a primary plat it would go to the Town Engineer for review, and then the Planning Commission would receive the secondary plat. Public notices letters would need to be sent to all property owners within 500ft or two ownerships, whichever was greater. Lee stated she would email Servies V12 of the Lapel Zoning Codes, as well as a copy of the public notice letter. Discussion was tabled until the May 6th meeting.

A motion to move the regular planning commission meeting scheduled for May 13th to May 6th at 6:30pm at the Lapel Eagles was made by Keith, 2nd by Wood; all were in favor.

Permit Fees: Wood stated he reviewed Lapel’s permit fees after last meeting, and can see they look very confusing when comparing them to surrounding town’s permit fee schedules. A discussion was held, and it was decided that at May’s meeting the Planning Commission would appoint a subcommittee to start adjusting permit fees. Any changes to these fees would not take place until after a public hearing was held.

A motion to adjourn the meeting was made by Retherford, 2nd by Duncan; all were in favor.
