Lapel Planning Commission

March 10, 2010 @ 6:30pm

Attending tonight’s meeting in person was Angie Callaway, Jeff Keith, Andrea Baldwin, Paula Lee, Dan Paddock, Matt Wood, Noah Bozell, Kourtney Krabbe, and Corrie Meyer. Legal counsel was not present at tonight’s meeting. The public could join the meeting either in person at the Lapel Eagles, or by joining the virtual GoTo Meeting link posted on the Town of Lapel’s Facebook page.

A motion to approve February 10, 2022 meeting minutes was made by Wood, 2nd by Lee; voting yes was Keith, Lee, Paddock, & Wood. Bozell, Callaway, & Baldwin all abstained due to not being present for that meeting.

A motion to approve building permits 2649-2651 was made by Wood, 2nd by Baldwin; all voted yes.

At this time Keith suspended the Planning Commission meeting & opened a public hearing for the rezone of 705 Main Street.

Tara Finely wants to rezone the property at 705 Main Street from Commercial to Residential so that she can build an addition & make the property her permanent residence. The property currently has 2 rooms & 1 bathroom. After the additional is built she would have 1000 sq. ft. of living space on a 4356 sq. ft. lot. No other public comments were made regarding this property.

At this time Keith closed the public hearing for rezone & resumed the Planning Commission meeting for staff comments.

Planning Director Corrie Meyer with Innovative Planning stated that the petition presented to the Planning Commission is just for a rezone, and did not include additional information about the potential expansion. A Residential zone for the property would be compatible with the block.

A motion to table the rezone for 705 Main Street until expansion plans are brought showing the improvements for the next meeting on April 14, 2022 was made by Callaway, 2nd by Bozell; all voted yes.

At this time Keith suspended the Planning Commission meeting & opened a public hearing for the rezone of 1028 Main Street. Councilman Bozell stepped off to the side during this time due to a conflict of interest.

Todd Bozell wants to rezone the property at 1028 Main Street from R2 to C1 to use it as a parking lot for The Station & the funeral home. They have already demolished the house that use to be on the lot, evened out the lot, and added stone. The plan is to pave the area after a year to let the stone & soil settle. Bozell stated he is thinking of having 27-28 parking spots, a ramp from the funeral home to the lot, & a ramp from Main Street into the lot. He will also add proper vegetation & lighting. The lot has already been grated to drain towards the drain inlets at the back of the property. Brian Miller would add a fence on the back of his property to act as a buffer between his lot & the Bozell lot. No further public comment was made.

At this time Keith closed the public hearing for rezone & resumed the Planning Commission meeting for staff comments.

Corrie Meyer stated that the petition is for rezone, & adequate information has been provided in order to do that. The Bozells’ will need to come back with site plans showing proper vegetation, lighting, green space, & curb ramps.

A motion to rezone 1028 Main Street from R2 to C1 & send to the Lapel Town Council with a favorable recommendation was made by Lee, 2nd by Wood; all voted yes except Councilman Bozell who abstained.

New Business: Rob Steele & Brian Miller would like to vacate the east & west alley between their properties. The Planning Commission stated they would need to present this to the Lapel Town Council for discussion.

Old Business: The Planning Commission would like updates on the Wyant property on SR 13 & on the property at 712 Main Street. Krabbe to get with legal & provide updates at next meeting.

The next scheduled meeting for the Board of Zoning Appeals is Monday March 21, 2022 @ 6:30pm at Lapel Town Hall & for the Planning Commission is Thursday April 14, 2022 @ 6:30pm at the Lapel Eagles.

Innovative Planning: Land Use Map. In the comprehensive plan that was just done last year, the steering committee chose areas to start rezoning for future potential use. These rezones would not affect current land owner’s tax rate as the tax rate is based on how the property is used & not how the property is zoned. For example if an Ag property gets rezoned to C1, that property can still be used as agriculture. However any new improvements made to the property would have to follow the new zoning codes under C1. Planning Commission President Keith stated he would like to move forward with the comprehensive plan vision. President Keith received a general consensus among the other board members.
