LAPEL PLANNING COMMISSION
FEBRUARY 13, 2025

In attendance: Matt Wood, Andrea Baldwin, Justin Mayes, Amy Egly, Brandon Hutchison, Teresa Retherford, Secretary and Evan McMullen, Legal Counsel.

Public Comment: William Vaughn owner of Storm Strike LLC. He spoke about 22 West Pendleton Avenue. He wanted the Commission to understand what he is trying to do. He would like for more time to get everything done. Wood explained about the zoning. The Variance was for minor mechanical work and car sales. McMullen explained that the Variance was supposed to be renewed every 3 years and that did not happen. He also explained that Mr. Vaughn would need a different Variance for the type of work he is doing. He stated that a rezone would be necessary. Retherford stated that his previous check he wrote has not been cashed yet. Mr. Vaughn stated he would stop by the office tomorrow and pick it up and write a new one for the correct amount. Marcellus, planning administrator for the town, told Mr. Vaughn he would work with him to get it on the March 6th BZA meeting. Kristie Worthman, a resident, spoke that she had filled his paperwork out for him. Mr. Vaughn said he needs to fill out a new plan and plot. Allicia West asked if the new housing additions are all under an HOA. McMullen stated that Montgomery Farms does have one in Phase 4 and Tuscany does as well. She stated that Senate bill 69 is about to be voted on. She wanted to make sure it was brought to the Commissions attention. Mr. Helterbrand wanted to know if the meeting on March 6th would be a public hearing. Wood mentioned that maybe Mr. Helterbrand should attend that meeting.

Dan Cutshaw wanted to introduce Debra Lazere. She will be helping Marcellus with Planning.

New Business: Address assignment for Weihe lots.

Staff recommended that Lot 1 be assigned 9591 W 650 S. and Lot 2 be assigned 9559 W 650 S.

Motion made to assign Lot 1 the address of 9591 W 650 S and Lot 2 be assigned 9559 W 650 S by Egly, 2nd by Baldwin and all were in favor.

Code Enforcement Update: The letters were sent to the house next to Smoky's by both regular mail and certified mail to the new address that was found. Baldwin asked if anything had been investigated at the Blue Church.

Planning Administrator Report: Marcellus said that Weihe Constructions addressing is done and they got their building permit last week. There will be a special BZA case on February 24th for the First Merchants ATM.
