LAPEL PLANNING COMMISSION
Thursday August 14, 2025

In attendance: Matt Wood, Amy Egly, Justin Mayes, Brandon Hutchison, Diane Pressler,
Teresa Retherford, Secretary and Evan McMullen, Legal Counsel.

Minutes: July 10, 2025
Motion to approve July 10, 2025 made by Hutchison, 2nd by Mayes and all were in favor.

Public Comment
Mike Helterbrand thanked whoever helped get 22 Pendleton Ave. He asked the
Commission to look over some information about things that still need done.
Mike Daniels asked if there is a map that shows a plan for the town. He also asked why
there isn't a plan that dictates exactly what will go on land in Lapel.

Old Business: None

New Business: Public Hearing: PUD-2025-02
Arbor Homes has submitted a revised application for re-zoning of the property south of SR
32 and west of CR S 900 W from C1 General Commercial to Residential PUD. The
application also proposes new ordinance to govern development in the PUD District,
known as Englewood. Concept plans propose 72 detached, single-family homes, a central
retention pond, and a playground and gazebo by the pond. Staff, Marcellus Johnson, read
through the staff report. Tony Baggato spoke on behalf of Arbor Homes. He went over the
changes made in this proposal.

Wood paused the regular meeting and opened the Public Hearing. Dave Benefiel asked
question pertaining to traffic on State Road 32. Kristie Worthman expressed her concerns
about the traffic around the school. She also spoke of the Comprehensive Plan. She feels
we should follow the Comprehensive Plan and have smart growth. She feels that keeping
this acreage as commercial seems more applicable. Amy Jones asked who would be
maintaining the fence along the property line adjacent to her property.

Wood closed the Public Hearing and resumed the regular meeting.

Egly stated she had a list of questions. She wanted to know what the timeline for
completion would be and what about our sewer capacity. Hutchison spoke on the sewer
capacity that he has concern that on a heavy rain day there isn't enough capacity. Johnson
stated that the PUD ordinances has an expiration date. Hutchison asked about them
helping with the park. Baggoto stated that they wouldn't be helping with the park because
they have green space in their PUD.

Motion to send an unfavorable recommendation to the Town Council made by Hutchison,
2nd by Egly and all were in favor except for Mayes.

Plan Commission Discussion
Code Enforcement Updates: House by Smoky's has been cleared. The Blue Church doesn't have any updates. Hutchison brought up a business on 800 is not zoned for a business. Wood stated that that property has a 99-year variance given by Madison County. McMullen asked if it was recorded. He stated that it needed to be investigated.

Planning Administrator Report: Johnson reported that there are no new non-residential
permits and no pending planning petitions. BZA updates that the State Bank needs a
variance to wave off street parking requirements for Sept 4, 2025 BZA meeting. The garage
that needs to be replaced. There is no paperwork yet. There is also another garage needing
to be replaced due to a fire.

Johnson then updated the Commission on the ROW permit fee structure.
