LAPEL PLANNING COMMISSION
APRIL 10, 2025
In attendance: Matt Wood, Justin Mayes, Amy Egly, Diane Presslor, Brandon Hutchison, Teresa Retherford, Secretary and Evan McMullen, Legal Counsel.
Adoption of Minutes: January 11th , 2024, and February 8th, 2024.
Motion to adopt minutes for January 11th ,2024 and February 8th, 2024, made by Mayes, 2 nd by Hutchison and all were in favor.
Public Comment: Resident in Tuscany asked about removing a tree next to his water meter. Wood suggested he contact the HOA. Hutchison said on the Utility side there was no problem with removing the tree. Wood stated that the Planning Commission did not have a problem with it either. Secretary Retherford asked that the resident have the HOA send a letter to her with their approval.
Old Business: Englewood PUD
Marcellus stated that he had met with them, and they would be making some revisions. Dominic Dryer from Arbor Homes stated they will be making significant changes, and they are asking for a continuation of the Public Hearing until next month. The Commission members all spoke of their concerns with the main one being traffic.
Public Hearing:
Wood then paused the Planning Commission meeting and opened the Public Hearing for Public
Comment. A resident asked if the town was the one to seek out Arbor Homes. The answer was no. Arbor Homes was the one to seek out Lapel. John Willis from Frankton-Lapel Schools spoke about traffic concerns and about being involved in the discussion of the traffic flow. Dave Benefiel had his concerns on the traffic and there must be a traffic impact study done by the developer. Mike Daniels, resident, brought up that he would like fewer homes. He wants us to control how our town is built up. Tony Mullet, who runs the Optimist Club, had questions about who owns the property in question and was curious as to why the property pins keep changing with every developer. He is very concerned about this. Hutchison explained that it's not necessarily the property lines. It is probably just stakes to survey from. A resident, concerned about traffic on Vine Street. She wanted to know about feedback for what residents in town want our town to look like. Egly stated that there are rules, and they must be followed. Kristie Worthman, a resident, was upset because she didn't know about it. Jim Bauer, a resident, was concerned about the water system and sewer system, roadways and the Fire Department. He is concerned about growth. A resident was concerned that the homes coming in would be able to cover the utility rates. He feels there needs to be a ratio of different priced houses. A resident said that the consensus is that we don't want cookie cutter houses. He feels the builders want to build as many houses as possible to make money. We want character.
Wood closed the Public Hearing and resumed the regular Planning Commission meeting.
Motion was made by Wood to continue the Public Hearing to next month, 2nd by Egly. All were in favor except for Hutchison who was against.
New Business: Address for Knoxson Miles Estates Addresses for 5 lots are Lots are:
- Lot 1: 5592 S 1000 W or 9915 SR 38
- Lot 2: 5658 S 1000 W
- Lot 3: 5724 S 1000 W
- Lot 4: 5790 S 1000 W
- Lot 5: 9791 SR 38
Motion made to approve the addresses with Lot 1 being 5592 S 1000 W. made by Wood, 2nd by Mayes and all were in favor.
Code Enforcement Update: There were no updates Planning Administrator Update:
The BZA had two petitions. The first was a variance to the patio at the Lapel Eagles Lodge on 9th Street for side setbacks and they were both approved. The second was 5 variances to Montgomery Farms for architectural standards to resemble houses built previously. Three were approved with conditions and 2 were denied. There were also INDOT section improvements are planning to build a roundabout at State Road 32 and Main Street and one at State Road 32 and State Road 13.
Motion made to adjourn the meeting by Wood, 2nd by Hutchison and all were in favor.
